The transcript of the oral arguments before the Supreme Court is available on the court's website and strongly suggests that at least six Justices will vote to save the Bladensburg Cross. The only Justices certain to dissent are Ruth Bader Ginsburg and Sonia Sotomayor, while Justice Elena Kagan appears to be on the fence. The Justices generally telegraph their feelings about cases by the questions they ask. In this case, those feelings for the most part were readily discernible.
