Does anybody else find it odd that there is a lesser penalty for attempted murder than murder? Are we rewarding incompetence?
Should be the same. Someone gets angry and shoots somebody else, the intent was to kill that person, lucky for him/her they lived, unlucky for the person who died. The act was still the same.
As with anything legal, there are degrees of attempted murder and murder. First, second and third degree murder is much worse than manslaughter or vehicular homicide (unless there is alcohol involved, at least in Missouri). Without a dead body, the :murder" never took place, only the planning of the murder.
