I agree with you. This is NOT a 3-way stop so giving way to the car on the right does not apply. Cars 2 & 3 are on a thru street with no stop signs. Car 3 has to wait till car 2 passes. Car 1 has to wait till both Cars 2 & 3 are through the intersection before he can enter the intersection.

I am an experienced driver but was just taking the piss out of the post ! Lol
@TheLiberalGent I checked with the our department of transportation and the driver to the right always has right of way unless they wave the other driver to proceed first. This also depends upon the order that the drivers appeared at the stop. Then it is polite to let the first driver there to go first etc.
@Marine If you will look at the diagram, there are NO STOP SIGNS.
