Wrongful death....i just signed a legal contract with my siblings to pursue a wrongful death lawsuit against the assisted living community where my mother was staying . The wee kkm of her 98th birthday some of the aides dropped he in transit to the concrete ground. It broke several bones including her hip, femur and leg. They put her back in her bed and reported nothing. During my sisters routine visit the next day my mother was screaming in pain. We transported her to the hospital. In treating the pain, she expired within 24 hours. We conducted an investigation to confirm the facts, and the policoes and procedures all of which were ignored. My sister who looked after my mother almost every day is beside herself in grief that my mothers last 48 hours were in so much pain.

After weeks of back and forth debate about to file a lawsuit or not, we agreed with the intent to make this hurt for them so it won't happen again. One can hope.

Its overall a terribly sad way to lose ones mother, the woman who nurtured and gave you life.

Would you have pursued the suit or just moved on?

I just came back from a visit to my old hometown in California and had the same discussion numerous times with old friends, about how the Kaiser Permanente HMO bungled my mother's care during her last months of life. It was 16 years ago and it still brings up a lot of anger. Mainly I wanted people to know that Kaiser should not be held up as the ideal health maintenance organization. There was no way to bring a wrongful death lawsuit at that time. I hope you get some restitution from this.

Persue it accidents happen but hiding it was pure neglect

I don't know what I would do? but this is criminal to me.I would call the ombudsman that oversees nursing home. To return her to her bed and say nothing and not give her immediate treatment I believe is a crime. They tried to cover up negligence at the cost of her suffering and dying. I think you should pursue it. I would not want to settle where it cannot be publicized of their negligence and cover up. I cannot imagine what you and your family are going through.

@gigihein thank you. My sister is tormented and terribly sad. I'm happy the pain is over. The case will be pretty clear cut, but I don't have any experience in this area so we will see what happens.

@Bigwavedave Of course ask your attorney, but every state has an ombudsman overseeing abuse neglect and exploitation in nursing homes, assisted livings.I am familiar with them. because my job is Adukt protective services, which is when the persons reported is in the community. They can investigate. I am unsure if they tell anyone of prior problems. I can't even imagine how horrendous this is for you all, but you are doing the right thing from my view.

Some things can't and shouldn't be ignored. In some homes today they have patient advocates(legal minded). My ex's
brother told me of websites that exsist that were created by OSHA . To have something of this magnitude not reported and acted on REALLY flies in the face of those caring for loved ones. I see your obligation a straightforward one ,
to prevent it from happening to others.

@bbjong thanks . I believe this lawyer is a pit bull. But I'm not familiar or experienced in these things . It's sad all around...mostly because I know that most of us will be alone and old when we pass. I think hit by a bus might be a better ending . Or a land shark, I dunno. Old and slow and painful is not right.
