When the childless Elizabeth I, the daughter of King Henry VIII, died in 1603, her throne and crown, by law and hereditary right, automatically passed to Lady Elizabeth Stanley, Countess of Derby.
The moment Elizabeth I drew her last breath, Elizabeth Stanley stood as the sole living lawful heir, immediately assuming her authority as the rightful successor and the lawful Queen of England. Succession is not contingent on ceremony, public recognition, or parliamentary approval—it is lawfully and automatically transferred through hereditary right the instant the previous monarch dies. When Elizabeth I died, the lawful throne did not pass to the Stuarts because Henry VIII’s will, which was passed through Parliament in 1544 as statute succession law, explicitly established the line of succession to prioritize his legitimate heirs by blood, following specific rules. Under Henry VIII’s will, the succession after his children — Edward VI, Mary I, and Elizabeth I — if they produced no heirs, was to pass to the heirs of his younger sister Mary Tudor, not the descendants of his elder sister Margaret Tudor, who married into the foreign Stuart line.
