8 U.S. Code § 1158. Asylum
( a ) Authority to apply for asylum
(1) In general
Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225( b ) of this title.
If they are here to apply for asylum, they have the legal right to do so. Trump is taking people who have reached the US and requested asylum and sending them back to Mexico. He has no legal right to do that.
Once they have applied for asylum, they are entitled to a hearing, and to remain in the US until the conclusion of the hearing.
While in the US they are protected by the Bill of Rights and the rest of the Constitution.
@SeaGreenEyez I think I'm beginning to see the situation clearer. If Trump had been more efficient and effective like Obama, less harm would have been done in the long run. So has Trump done the wrong thing for the right reason, that is, to allow legal process all the time it needs to complete applications thoroughly or has he just done this to make foreign people suffer? It sure is an argument for cold efficiency.
