apparently its actually against the constitution to expect citizens too do the work of a government agent in such a way

It Should work....you could even start a new "religion" based on this one tenet, bodily autonomy.

As far as I know the only case law on this would be the court's decision regarding Native Americans and the use of Peyote as a sacrament.

The Supreme Court of the United States, in the case of Employment Division v. Smith, 494 U.S. 872 (1990), held that the First Amendment does not protect Indian practitioners who use peyote in Indian religious ceremonies. In response to the decision written by Justice Scalia, Congress passed 42 U.S. Code § 1996a which protects the rights of Native Americans to use peyote.

That's a long winded way of saying the conservatives on the court may not give a damn about 1st Amendment rights when it doesn't suit their agenda. Congress is our best hope.
