He Could have called 911, instead he became an accessory, just as a get-away driver in a bank robbery is guilty even though not in the bank...if the robbery results in murder, he is guilty of murder!
I would think he would be safe as he is the person who helped find the criminals.

He failed to intervene as someone was being murdered...and by intervene I mean call 911. Making him an accessory, duhhhh.
