End of the month and no response from nursing home re my request for a letter exempting me from consuming medical products in order to visit my close relative.
So it's off to court I go. A civil case. Will file tomorrow.
My first claim will be for $17.40, the cost of the product I was forced to consume against my will. Why should I pay for it?
Then compensation for personal "hurt". whatever the correct legal term is. I'll leave that figure up to the judge (magistrates court can go up to $150,000). Money not my goal.
I will be asking why my resident father can refuse a flu jab but as a visitor, I cannot.
I will ask how a flu jab protects against Covid-19, which is the legal basis for flu jabs being mandated.
I will ask why in NSW and other states I may seek an exemption but in Qld not, when it is a federally mandated law.
I really hope they bring up safety, I would class myself as having expertise in risk assessment and hazard management in confined living (remote camps on drilling rigs).
I'm going for the facility who enforced the mandate rather than the govt that made it. Comes down to "personal" responsibility you see. They made a choice to enforce the mandate so they need learning that following directives that are not legal is no excuse when infringing on human rights. As a nursing facility, they should know full well that medicine can not be given without consent, and it does not matter what skidmark mandated under powers gained from a pandemic being declared for an unrelated virus.
I will get my exemption letter through the court and have fun doing it.
Fuck 'em.
Not anti vax, pro consent.
Good luck. Please give updates. Do not be surprised if you are pushed down the list to 2025.
