So as of yesterday my job (Lowe's) laid me off without notice. They are doing away with the FSA (Facility Service Associate) position. With that being said, are all employers required to give you severance pay if they don't give you a sixty day notice? There is a law called The Warn Act that states this to be true. I really want to know. Any and all help/advice would be appreciate. To everyone reading this I hope you all have a wonderful day.
you definitely would be entitled to severance in canada & europe. but in the land of the free to starve, trickle-down economy, probably not.
Being laid off w/out severance may mean you are entitled to immediate unemployment. I was laid off w/4 weeks severance back in 2000 & had to wait for unemployment to kick in after that 4 weeks. When I was laid off in 2004 w/out severance, unemployment kicked in right away.
Can’t say for USA but in most other Western countries that I am aware of there is a probationary period where either party can’t part ways with probably one week notice or payment in lieu.
Outside of the probationary period it will depend upon the contract that was signed.
Severance pay is Never guaranteed unless you have it in a written employment contract, sorry.
You should, however, make a (free) phone call to your state's Labor/Employment office to double-check. Also apply for unemployment Immediately, there is no "back pay" on that.
So sorry to hear that! How many of you are being laid off? It makes a difference.
@BornCountry The reason I asked was because I think the WARN act only applies if there are 50 or more people per facility. VA is a right to work state and there is no federal law that mandates severance pay. About 20 people were laid off from Sam's Club here, including my girlfriend who had worked them for over 35 years...only the people who had worked more than 20 years got any kind of severance. It sucks.
60 day notice?
I got a 60 day notice in San Diego Ca in 1993 when General Dynamics/Convair laid over 4000 people off,when a missile program ended.But it depends on how many, and each State is different.
@Mike1947 60 day notice is as rare as 4000 people being let go at once, and also I imagine it having an end date on a government contract would be hard to conceal - plus, by giving long notice they most probably didn't give severance pay (I'm assuming).
I've never let anyone go and kept them for any time. 2 week severance and depending on circumstances a thanks and a sorry. But then I've never terminated employment on a large scale and most times it was performance related and didn't want things to be worse by having an already bad employee become even worse.
