Police can't kill you just because they see a gun.(especially if your state allows open or conceal carry) If you are in process of committing a crime then that may be a different story.

That’s untrue. If there are no consequences to killing a person just because they are armed, then that is the same as not having the right to carry arms.
Correct. Besides possession, there has to be an imminent threat. Sadly this is loosely interpreted to favor the police.
